OFFER TO ENTER INTO A CONTRACT FOR THE SALE OF GOODS
The online store specializing in temporary tattoos (hereinafter referred to as the Seller) publishes this agreement, which constitutes a public offer contract (hereinafter referred to as the Agreement) and has full legal effect for the sale of goods presented on the Seller’s official website https://arleysign.com to individuals and legal entities (hereinafter referred to as the Buyer) under the terms and conditions outlined below:
1. GENERAL PROVISIONS
1.1. The contractual relationship between the Seller and the Buyer is formalized in the form of a public offer agreement.
1.2. Pursuant to Articles 633, 641, and 642 of the Civil Code of Ukraine (hereinafter referred to as the CCU) and the Rules for the Sale of Goods by Order and Outside Commercial or Office Premises, approved by the Order of the Ministry of Economy of Ukraine No. 103 dated April 19, 2007, this document is an offer, and the act of placing an order by the Buyer, either verbally (by phone) or in writing (via the website), and the Seller’s acceptance of the order constitutes full and unconditional acceptance of this public offer and the information provided on the website.
2. TERMS AND DEFINITIONS
- Offer: A public proposal by the Seller addressed to any individual or legal entity to enter into a sales contract under the existing terms specified in the Agreement.
- Acceptance: Full and unconditional acceptance by the Buyer of the terms of the Agreement without signing the Agreement in writing.
- Website: https://arleysign.com.
- Goods: A list of items available on the Seller’s official website https://arleysign.com.
- Seller: The online store for temporary tattoos, Arley Sign.
- Buyer: An individual or legal entity entering into a contractual relationship with the Seller under the terms outlined in the Agreement.
- Order: A properly completed request by the Buyer to purchase Goods addressed to the Seller.
- Courier Delivery: The direct transfer of Goods from the Seller to the Buyer by an independent contractor providing services to the Seller under a separate agreement.
3. SUBJECT OF THE AGREEMENT
3.1. The Seller undertakes to sell the Goods as per the Order placed by the Buyer under the terms and conditions of this Agreement, while the Buyer agrees to purchase and pay for the Goods under the terms specified in this Agreement.
4. ORDER PLACEMENT PROCEDURE
4.1. The Buyer may place an Order independently on the Website or by phone with the assistance of an operator.
4.2. Orders are accepted by the Seller 24/7.
4.3. To place an Order via the Website, the Buyer must:
- Select Goods from the Website, specify the quantity, and click “Order,” which will automatically add the Goods to the “Cart.”
- Fill out the required fields in the electronic order form and select a payment method.
- Complete the order by clicking the “Place Order” button.
4.4. An Order is considered placed and accepted for fulfillment by the Seller if:
- The Buyer confirms agreement with the Order by ticking the respective box and agrees not to receive a confirmation call.
- The Seller’s call center operator confirms the acceptance of the Order verbally during a phone call.
4.5. If the call center operator does not confirm the acceptance of the Order, such an Order is deemed unplaced and will not be processed.
4.6. The Buyer bears full responsibility for the accuracy and correctness of the information provided when placing the Order.
4.7. The Seller agrees to provide the Buyer with all necessary information related to the Goods, the placement, and fulfillment of Orders.
5. DELIVERY OF ORDERS
5.1. The Buyer can receive the ordered Goods either via self-pickup from the designated collection point or via courier delivery.
5.2. Self-pickup is performed by the Buyer from the collection point specified by the Buyer during the order placement process, based on the options provided by the Seller’s call center operator when confirming the order.

5.3. Delivery of the ordered Goods is carried out within Ukraine unless otherwise agreed upon by the parties.
5.4. Delivery delays may occur due to unforeseen circumstances beyond the Seller’s control.
5.5. The Order is delivered to the address specified by the Buyer in the order.
5.6. Ownership of the Goods and the risk of accidental damage or loss pass to the Buyer upon the transfer of the Goods.
6. PAYMENT FOR GOODS
6.1. Prices for Goods are set unilaterally by the Seller and are indicated on the website. The price of the Goods ordered by the Buyer cannot be changed.
6.2. Payment for Goods is made in the national currency of Ukraine – hryvnia.
6.3. The total cost of the order includes the price of all Goods specified in the confirmed order, applicable taxes and fees, and order assembly costs.
6.4. If the Buyer selects non-cash payment, the Goods will only be delivered after full payment has been made. Payment is considered complete once the funds are credited to the Seller’s account.
6.5. The Seller reserves the right to suspend or cancel the Order if the Buyer fails to fulfill the payment obligations prior to delivery.
7. RETURN POLICY
7.1. The Buyer has the right to refuse Goods of inadequate quality upon inspection at the time of receipt.
7.2. Upon receiving the Goods, the Buyer must check the correspondence of the received Goods to the order, completeness, and absence of claims to the external appearance of the Goods within 10 minutes of receipt.
7.3. If defective Goods or discrepancies are identified, the Buyer may demand replacement of such Goods within 5 minutes of inspection.
7.4. Claims not presented in accordance with the terms of this Agreement will not be accepted.
7.5. For defective Goods paid for via non-cash methods, the Seller shall refund the Buyer within three banking days.
8. FORCE MAJEURE
8.1. The Seller is released from liability for partial or complete non-fulfillment of obligations under this Agreement caused by force majeure circumstances, including war, terrorism, natural disasters, legal restrictions, and other extraordinary events.
9. TERM OF THE AGREEMENT
9.1. This Agreement is considered concluded at the time the Buyer completes the Order and the Seller confirms its acceptance.
9.2. The Agreement remains valid until all obligations of both parties are fulfilled.
10. COPYRIGHT
10.1. All textual and graphical content on the website https://arleysign.com is the property of “Arley Sign Temporary Tattoos.”
11. RIGHTS AND OBLIGATIONS OF THE PARTIES
11.1. The Seller undertakes to sell Goods in accordance with the terms of this Agreement, while the Buyer agrees to accept and pay for the Goods.
11.2. The Seller has the right to:
- Refuse to sell Goods due to the Buyer’s non-compliance with this Agreement.
- Amend this Agreement unilaterally.
- Use third parties to fulfill its obligations to the Buyer.
11.3. The Buyer agrees to:
- Comply with the terms of this Agreement.
- Inspect and verify the Goods upon receipt.
- Pay for the Goods prior to or upon receipt.
